Is your SPCC Plan up-to-date with the final amendments to 40CFR, Part 112?

The United States Environmental Protection Agency recently published amendments to 40 CFR Part 112 in final form with an effective date of August 16, 2002, giving facility owners and operators until February 17, 2003 to amend (if necessary) their SPCC Plans to ensure compliance with the newly revised regulations.

If you currently have 1320 gallons of oil or oil-related product stored above ground and, due to location, could reasonably be expected to discharge oil in harmful quantities into or upon navigable waters, you are required by law to have a Spill Prevention, Control and Countermeasure (SPCC) plan in place. This oil spill prevention plan is required by the Federal Water Pollution Control Act to prevent spills from reaching navigable waters. An organization that fails to prepare and maintain such a plan can be subject to a penalty of up to $25,000 per day.
